DESCRIPTION:The North Carolina Department of Environmental Quality’s Division of Air Quality (DAQ) is seeking public comment on a draft air quality permit for the Carolina Poultry Power RG3\, LLC facility in La Grange. Public comment will be accepted until Aug. 17\, 2022. \nCarolina Poultry Power\, a proposed biomass-to-energy facility\, applied for a permit to operate a lime storage silo and a boiler that will fire used poultry bedding to generate electricity. As proposed\, the facility will be classified as synthetic minor. To prevent the facility from becoming a Title V major source under the Clean Air Act\, the draft permit contains specific conditions limiting criteria air pollutant emissions to less than 100 tons per year (each)\, the greatest potentially emitted hazardous air pollutant (HAP) to less than 10 tons per year\, and total emissions of HAPs to less than 25 tons per year. \nTo comply with the conditions\, the facility must properly operate and maintain emissions control equipment\, including a multicyclone\, injection control systems\, fabric filters and bag filters. Atmospheric dispersion modeling reviewed by DAQ shows that the facility can comply with health-based standards. \nCopies of the draft permit\, permit review\, permit application and draft environmental justice report are available online. \nComments or requests for a public hearing will be accepted until Aug. 17\, 2022\, at 5 p.m. Comments can be emailed to daq.publiccomments@ncdenr.gov with “CPP.22A” in the subject line. These priority rating systems are being considered by the Authority for use in ranking applications for project funding. \nThe Intended Use Plans (IUPs) for the Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Fund (DWSRF) programs provide details on administration of the Fiscal Year 2022 Federal Capitalization Grants for the State Revolving Funds\, including supplemental funding from the Bipartisan Infrastructure Law (BIL). DESCRIPTION:State Accepting Public Comments on Draft Permit to address Chemours Groundwater Contamination \nPermit is part of remediation plan to prevent PFAS discharge to the Cape Fear River \nThe North Carolina Department of Environmental Quality Division of Water Resources (DWR) is accepting public comments on a draft permit to treat PFAS-contaminated groundwater\, surface water and stormwater from the Chemours Fayetteville Works site before discharge into the Cape Fear River. The National Pollutant Discharge Elimination System (NPDES) wastewater permit is part of the required actions to prevent residual PFAS pollution from entering the Cape Fear River\, as outlined in the 2020 Addendum to the 2019 Consent Order. \nThe draft NPDES permit only allows the discharge of treated water associated with the remediation activities. It does not allow the discharge of wastewater from plant operations or processes. \nUnder the 2020 Addendum\, Chemours was required to address four identified seeps that account for more than half of the PFAS contamination in the groundwater entering the river. The required interim measures have been installed and Chemours has submitted plans to DEQ for approval of the permanent measure: a more than one-mile-long\, subsurface barrier wall and groundwater extraction system to capture contaminated groundwater and prevent it from entering the Cape Fear River. The draft NPDES permit requires treatment to remove PFAS contamination from the groundwater\, surface water and stormwater captured by the extraction system before discharge into the Cape Fear River. The mill will process southern yellow pine logs and includes lumber operations\, lumber drying\, planer mill\, and an emergency fire water pump. \nThe facility will be constructed in two phases: the first phase will support up to 300 million bd-ft per year of lumber drying capacity. The second phase will support additional 200 million bd-ft per year lumber drying capacity bringing the total capacity to 500 million bd-ft/yr. Even though the facility will be constructed in two phases\, this PSD permit approval is for the entire project (five kilns and ancillary equipment). \nThe facility is a new “major stationary source” for at least one regulated NSR pollutant (VOC). These reforms would restore durability and regulatory certainty\, cut down on conflict\, deliver sounder results on the ground\, and aim to get more American workers on the job building our next generation of infrastructure. \n“The basic community safeguards we are proposing to restore would help ensure that American infrastructure gets built right the first time\, and delivers real benefits – not harms – to people who live nearby\,” said CEQ Chair Brenda Mallory. “Patching these holes in the environmental review process will help reduce conflict and litigation and help clear up some of the uncertainty that the previous administration’s rule caused.” \nThe proposed rule would make the following three important changes to the 2020 NEPA rules: \n\nRestore the requirement that federal agencies evaluate all the relevant environmental impacts of the decisions they are making. This proposed change would make clear that agencies must consider the “direct\,” “indirect\,” and “cumulative” impacts of a proposed decision\, including by evaluating a full range of climate change impacts and assessing the consequences of releasing additional pollution in communities that are already overburdened by polluted air or dirty water.\nRestore the full authority of agencies to work with communities to develop and analyze alternative approaches that could minimize environmental and public health costs. This proposed change would give agencies the flexibility to determine the “purpose and need” of a proposed project based on a variety of factors\, and to work with project proponents and communities to mitigate or avoid environmental harms by analyzing common sense alternatives. The 2020 NEPA rule limited federal agencies’ ability to develop and consider alternative designs or approaches that do not fully align with the stated goals of the project’s sponsor\, often a private company.\nEstablish CEQ’s NEPA regulations as a floor\, rather than a ceiling\, for the environmental review standards that federal agencies should be meeting. This proposal would restore the ability of Federal agencies to tailor their NEPA procedures\, consistent with the CEQ NEPA regulations\, to help meet the specific needs of their agencies\, the public\, and stakeholders.\n\nCEQ is inviting public comment on these proposed revisions.
