DESCRIPTION:State Accepting Public Comments on Draft Permit to address Chemours Groundwater Contamination \nPermit is part of remediation plan to prevent PFAS discharge to the Cape Fear River \nThe North Carolina Department of Environmental Quality Division of Water Resources (DWR) is accepting public comments on a draft permit to treat PFAS-contaminated groundwater\, surface water and stormwater from the Chemours Fayetteville Works site before discharge into the Cape Fear River. The National Pollutant Discharge Elimination System (NPDES) wastewater permit is part of the required actions to prevent residual PFAS pollution from entering the Cape Fear River\, as outlined in the 2020 Addendum to the 2019 Consent Order. \nThe draft NPDES permit only allows the discharge of treated water associated with the remediation activities. It does not allow the discharge of wastewater from plant operations or processes. \nUnder the 2020 Addendum\, Chemours was required to address four identified seeps that account for more than half of the PFAS contamination in the groundwater entering the river. The required interim measures have been installed and Chemours has submitted plans to DEQ for approval of the permanent measure: a more than one-mile-long\, subsurface barrier wall and groundwater extraction system to capture contaminated groundwater and prevent it from entering the Cape Fear River. The draft NPDES permit requires treatment to remove PFAS contamination from the groundwater\, surface water and stormwater captured by the extraction system before discharge into the Cape Fear River. The system must remove at least 99% of PFAS and meet daily and monthly effluent limits as specified in the permit conditions. \nThe proposed NPDES permit does not change the conditions of any previous NPDES permit held by Chemours. \nDWR is accepting comments on the draft permit until May 2\, 2022. DESCRIPTION:EPA invites the public to participate in two identical virtual public meetings related to environmental justice and the development of the proposed Drinking Water Regulation (NPDWR) for Per- and Polyfluoroalkyl Substances (PFAS) on March 2\, 2022 (1:00 pm to 4:00 pm\, eastern time) and April 5\, 2022 (5:00 pm to 8:00 pm\, eastern time). Registration is required. \nThe sessions will be an opportunity for EPA to share information and for communities to offer input on environmental justice considerations related to the development of the proposed PFAS NPDWR. EPA is currently developing a proposed NPDWR for Perfluorooctanoic acid (PFOA) and Perfluorooctane sulfonic acid (PFOS)\, two types of PFAS. EPA is also evaluating additional PFAS and assessing the available science to consider regulations for groups of PFAS. NPDWRs are legally enforceable maximum contaminant levels (MCLs) or treatment techniques that apply to public water systems. MCLs and treatment techniques protect public health by limiting the levels of contaminants in drinking water. \nIn October 2021\, EPA released the PFAS Strategic Roadmap (https://www.epa.gov/pfas/pfas-strategic-roadmap-epas-commitments-action-2021-2024) laying out an approach to addressing PFAS across the Agency. Establishing an NPDWR for PFOA and PFOS is a key action in the Roadmap.

DESCRIPTION:The White House Council on Environmental Quality (CEQ) has announced a series of public listening sessions and training webinars on the beta version of the Climate and Economic Justice Screening Tool (CEJST). The next public listening session on the beta version of this tool will be held on April 15th at 4:00 PM. Register for the April 15th Public Listening Session! \nThe CEJST will help Federal agencies identify disadvantaged communities for the purposes of the Justice40 Initiative—a signature initiative of the Biden-Harris Administration that seeks to provide 40 percent of the overall benefits of certain Federal investments to disadvantaged communities. The current version of the tool is in a public beta form and will be updated based on public feedback and research. By law\, the commission is required to submit annual progress reports to the Joint Legislative Commission on Energy Policy and the Environmental Review Commission. The Oil and Gas Commission and a reconstituted Mining Commission were created to carry out the regulatory responsibilities of the former state Mining and Energy Commission. The General Assembly eliminated the Mining and Energy Commission after the commission had adopted rules that govern oil and gas exploration and development in North Carolina. The Oil and Gas Commission has nine members. A total of four members are appointed by leaders in each chamber of the General Assembly. The remaining five members are appointed by the governor. Members serve for four years.

The SRF program offers low-interest loans (with principal forgiveness) for water infrastructure\, including water and wastewater treatment facilities\, wastewater collection systems\, water distribution systems\, reclaimed water facilities\, energy efficiency upgrades\, stormwater control measures and stream restoration projects. \nThree plans or priority rating systems are available for public comment: \n\nThe Drinking Water SRF IUP and Priority Rating System for drinking water infrastructure projects: Draft 2022 DWSRF & BIL Supplemental DWSRF IUP .\nThe Clean Water SRF IUP and Priority Rating System for clean water infrastructure projects: Draft 2022 CWSRF & BIL Supplemental CWSRF IUP.\nThe Community Development Block Grant-Infrastructure Program Priority Rating System is used to develop scores for evaluating applications: CDBG-I Draft Priority Rating System.\n\nThe proposed rating systems prioritize assistance to community applicants with greater socioeconomic constraints\, and to projects benefitting disadvantaged areas. Chemours is required to remove at least 99% of PFAS from the contaminated groundwater before discharge. Currently\, contaminated groundwater flowing into the river is not intercepted or treated. \nDWR will continue to accept comments on the proposed National Pollutant Discharge Elimination System (NPDES) wastewater permit through 5 p.m.\, June 24. The draft NPDES permit (NC0090042) allows only the discharge of treated water associated with groundwater remediation efforts\, primarily treated groundwater\, some surface water and stormwater. It would not allow the discharge of wastewater from Chemours manufacturing processes. \nAs outlined in the 2020 Addendum to the Consent Order\, Chemours is required to address groundwater contamination by installing an underground barrier wall that will run more than a mile alongside the Cape Fear River. This wall will intercept contaminated groundwater from the facility before it reaches the river\, and a series of extraction wells will pump the captured groundwater to a treatment system. The draft permit requires that the treatment system remove at least 99% of PFAS from the pumped groundwater before it enters the river. Without this treatment system intervention and accompanying discharge permit\, this heavily contaminated groundwater would continue to flow to the river untreated and continue to impact downstream water supplies.
